GENERAL TERMS AND CONDITIONS OF CHRISTCHURCH ADVENTURE PARK USE, RELEASE OF LIABILITY and ASSUMPTION OF RISKS AGREEMENT

WARNING:  Hiking, mountain biking, ziplining and other adventure activities, including riding the chairlift, can be hazardous and carry elements of risk.

Our aim is to provide a safe and enjoyable adventure environment for all our customers, visitors and staff.  By undertaking adventure activities in the Christchurch Adventure Park you agree to comply with the Terms and Conditions of Park Use.  YOU AGREE TO ASSUME THE RISK OF ANY INJURY TO YOUR PERSON OR PROPERTY resulting from any of the inherent dangers and risks of hiking, mountain biking, ziplining and chairlift riding and MAY NOT RECOVER FROM PORT HILLS LEISURE LIMITED, THE CHRISTCHURCH ADVENTURE PARK OR ITS EMPLOYEES FOR ANY INJURY resulting from any of the inherent dangers of adventure activities.

Inherent dangers of adventure activities include, but are not limited to, slips, falls, trips, collisions with natural objects, man-made objects or other riders, hikers, domestic or wild animals, variations in terrain, and the failure of riders to ride within their own abilities.  Other risks include changeable weather conditions, cliffs, steep and extreme terrain, jumps and drop-offs. Riders and hikers are responsible for having the physical dexterity to safely load, ride and unload from the chairlift.

Helmets are required for all mountain biking and ziplining activities. For mountain biking, protective gear is highly recommended and the rider must control speed and course at all times.  Visitors to the park agree to ASSUME ALL RISKS, inherent or otherwise, and RELEASES PORT HILLS LEISURE LIMITED, CHRISTCHURCH ADVENTURE PARK AND ITS EMPLOYEES FROM ANY AND ALL LIABILITY for any loss, damage, expense, or injury that you or a third party may suffer resulting from your use of or presence at the Park.

Christchurch Adventure Park reserves the right to refuse entry or service to anyone for any reason at any time.

HEALTH and MEDICAL

Adventure activities can activate or aggravate existing or pre-existing injuries, conditions or congenital defects. If you know or suspect that your physical condition may not be compatible with these activities please seek medical advice before undertaking them.

In the event of an incident that causes you injury, you consent to CAP providing first aid and contacting emergency services on your behalf. You consent to the provision of any relevant medical information to medical services and/or safety agencies.

PRIVACY

CAP respects your privacy and complies with the Privacy Act 1993. You are entitled to access the personal information we hold about you and to request that we amend it if it is incorrect. While dealing with you, we may collect personal information, such as your name, address and contact details, as well as your interaction with our website and computer systems. By providing us with your email address you consent to receiving emails from us advising of updates, products and services available. You may unsubscribe from our email database at any time.

PAYMENT, CANCELLATION AND REFUNDS POLICY:

PAYMENT TERMS: All prices quoted by Christchurch Adventure Park are in New Zealand dollars.  Prices include GST. Payment for Zipline tours will be taken at the time of booking unless otherwise advised. NO RESALE.

CANCELLATIONS: You can cancel or amend your Zipline Tour booking without charge until 24 hours prior to your tour departure.  After that time any cancellation will not be refunded. Changes to a booking within this 24hour period will incur a $25 fee. “No-shows” will not receive a refund. Cancellations for groups of 10 or more participants require 72hours notice for a refund.

Christchurch Adventure Park reserves the right to cancel zipline tours due to inclement weather, foreseeable hazards, insufficient bookings, or events beyond our control. In these circumstances, full refunds will be made or alternative dates offered. In the case of inclement weather that is likely to prevent a tour proceeding, a Guest Services representative will contact the booking owner on the phone number provided at time of booking.

POLICY CHANGES:

Christchurch Adventure Park reserves the right to make changes to this policy statement from time to time.
